Acceptance of Terms
By accessing or using HEKMA ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
These Terms apply to all visitors, registered patients, and any other users of the Platform. HEKMA reserves the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Platform after changes constitutes acceptance.
Description of Service
HEKMA is a patient education and clinical trial matching platform. We help patients discover, understand, and connect with clinical trials relevant to their health conditions.
HEKMA is NOT:
• A medical provider, healthcare professional, or medical advice service.
• A sponsor, contract research organisation (CRO), or clinical trial site.
• A substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your qualified healthcare provider with questions you may have regarding a medical condition or before starting, stopping, or changing any treatment.
Eligibility to Use
You must be at least 18 years of age to register for and use the Platform. By using the Platform, you represent that you are 18 or older. If you are under 18, you may not use the Platform without the involvement of a parent or legal guardian.
You must provide accurate, current, and complete information during registration and keep your account information updated.
Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at support@hekma.health if you suspect unauthorised access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive or harmful behaviour.

THE PLATFORM DOES NOT PROVIDE MEDICAL ADVICE.
Content on HEKMA — including trial descriptions, condition information, news articles, and blog posts — is for informational and educational purposes only. It does not constitute medical advice, and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
Trial eligibility, risks, and participation requirements must be confirmed directly with the clinical trial site and your healthcare provider. HEKMA makes no guarantees that you will qualify for any trial you discover on our Platform.
No Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
HEKMA does not warrant that:
• The Platform will be uninterrupted, error-free, or secure.
• Trial information is always current or complete (trial availability changes).
• Any particular trial will be suitable for or available to you.
• Results of using the Platform will meet your expectations.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HEKMA AND ITS OFFICERS, EMPLOYEES, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR:
• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, goodwill, or other intangible losses.
• Damages arising from your use of or inability to use the Platform.
• Decisions you make based on information provided by the Platform.
In no event shall HEKMA's total liability exceed the amount you paid to HEKMA in the 12 months preceding the claim (or $100 if no payments were made).
Intellectual Property
All content on the Platform — including text, graphics, logos, icons, and software — is the property of HEKMA or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.
You retain ownership of any health information and other data you submit to the Platform. By submitting data, you grant HEKMA a limited licence to use it solely to provide and improve the trial matching service.
Prohibited Activities
You agree not to:
• Use the Platform for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Platform or its systems.
• Scrape, crawl, or extract data from the Platform using automated means.
• Impersonate any person or entity, or misrepresent your affiliation.
• Submit false, misleading, or fraudulent health information.
• Use the Platform to spam, harass, or harm other users.
• Interfere with the security or integrity of the Platform.
Termination
HEKMA may suspend or terminate your access to the Platform at any time, with or without notice, for any reason including breach of these Terms.
You may close your account at any time by contacting support@hekma.health. Upon closure, we will delete or anonymise your personal data in accordance with our Privacy Policy.
Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
For users in the UAE, local mandatory consumer protection laws may also apply.
Any disputes shall first be submitted to informal negotiation for 30 days. If unresolved, disputes shall be settled by binding arbitration in Delaware, except that either party may seek injunctive relief in any court of competent jurisdiction.
